PART 1: CONDITIONS OF SALE

These terms and conditions of sale (“Conditions of Sale”) (together with the documents referred and linked to in them) tell you (“you”, “You” or “Your” being a user of the site and/or purchaser of Products) the terms and conditions on which we shall install the Plaques and supply to you the Replica Plaques (“Products”) listed on our website celebrationcorner.arsenal.com our “site”. Please read these Conditions of Sale carefully before ordering any Products from our site. You should understand that by ordering any of our Products, you agree to be bound by these Conditions of Sale. These Conditions of Sale are only available in the English language.

You should print a copy of these Conditions of Sale for future reference.

Please tick the relevant box if you accept these Conditions of Sale. Please understand that if you refuse to accept these Conditions of Sale, you will not be able to order any Products from our site.

GENERAL

Products are supplied by Intaglio Creative Limited on behalf of The Arsenal Football Club Limited, registered in England under company No.00109244 with registered office at Highbury House, 75 Drayton Park, London, N5 1BU. The Arsenal Football Club Limited will be the payment processor.

INTAGLIO CREATIVE LIMITED

Intaglio Creative Limited design, manufacture, sell and deliver personalised products which usually offer lasting tributes of historical significance. 

Intaglio Creative Limited are authorised to sell the Products via the website celebrationcorner.arsenal.com. Intaglio Creative Limited are a company registered in England under company No.08827851 and with our registered office and main trading address at Castle House, South Street, Ashby-De-La-Zouch, Leicestershire, England, LE65 1BR. (“we”, “us”, “our”, “Intaglio Creative”).

YOUR STATUS

By placing an order through our site, you promise that: (a) you are legally capable of entering into binding contracts; and (b) you are at least 18 years old.

HOW THE CONTRACT IS FORMED BETWEEN YOU AND US

Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm your order by sending you an e-mail that confirms your order (“Order Confirmation”) and provides you with an order reference number. This number should be retained for future reference. The contract between us will only be formed when we send you the Order Confirmation. The contract will relate only to those Products we have confirmed in the Order Confirmation. We will not be obliged to supply any other Products which may have been part of your order unless and until such Products have been confirmed in a separate Order Confirmation.

ANY ORDER CONFIRMATION GIVEN IS STILL SUBJECT TO THESE CONDITIONS OF SALE.

We reserve the right to withdraw any Products from the site and may, in our sole discretion, refuse to process an order for any reason at any time. Without prejudice to your statutory rights as a consumer, we will not be liable to you or a third party by reason of us withdrawing any Products or refusing to process any order.

YOUR ORDER

At the time of purchase of the Plaque, you are able to input text (in uppercase and subject to a maximum number of characters across a maximum number of lines as shall be specified for each Plaque size on the celebrationcorner.arsenal.com website) (“Message Inscription”). The Arsenal Football Club Limited hereby reserves the right to reject and/or require you to amend any Message Inscription which it considers in its absolute discretion to be unsuitable, inappropriate or offensive.

You shall not be entitled to pick the location of installation or colour of the Plaque which shall be determined by The Arsenal Football Club Limited in its sole discretion. Replica Plaques must take the exact form of the Plaque and must have the same Message Inscription as the Plaque.

When your order includes the purchase of a Replica Plaque, the Replica Plaque shall be delivered in accordance with these terms and conditions.

You will receive an email confirmation once your Plaque has been installed at Emirates Stadium.

CHANGES TO YOUR MESSAGE INSCRIPTION 

You shall be entitled to make changes to the Message Inscription during the 28 days following your Order Confirmation by logging into your account at celebrationcorner.arsenal.com. After the 28 days, your Message Inscription shall be locked and you will no longer be entitled to make any changes.

AVAILABILITY

All Products shown on the website are subject to availability. In rare instances, we may not be able to deliver your Products, even though we have indicated there is availability. Where this is the case, we will inform you of this by email and will give you the option of selecting another Product or cancelling your order.

DELIVERY OF REPLICA Plaques

Delivery shall be made in accordance with the selection made at the time of purchase. Delivery charges apply for Products and are as set out at the time of purchase. Delivery will be completed when we deliver the Products to the address stated in your order.

RISK AND TITLE 

The Replica Plaques will be at your risk from the time of delivery. This means that as soon as the Replica Plaques are delivered to you, you are responsible for them.

Ownership of the Replica Plaques will only pass to you when we receive full payment of all sums due in respect of the Products you have ordered, including delivery charges.

For the avoidance of doubt, ownership of the Plaques remains with the Club at all times.

PRICE AND PAYMENT

All prices are as quoted on the website from time to time, except in cases of obvious error. Product prices are in £ sterling and  are inclusive of any applicable value added tax applicable in the UK or elsewhere in the European Union. If the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the Products in full before the change in VAT takes effect. Delivery charges apply for Products and are as set out at the time of purchase. Except in the case of obvious error, the prices payable for the Products that you order are as set out on the site at the time at which you place your order.

Product prices and delivery charges are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a confirmation e-mail.

Payment may be made using a wide selection of credit and debit cards. The acceptable methods of payment are referred to on our website. We have the right to vary the acceptable methods of payment without notice from time to time. However, if you have already submitted your order and the payment method you used is subsequently discontinued we will still try to process your order using the original payment method and will contact you if there is any issue which prevents this.

You confirm that the credit or debit card that is being used is yours. If the issuer refuses to authorise payment, we will not accept your order and we will not be responsible for delay or non-delivery and we are not obliged to inform you of the reason for refusal. We are not responsible for your card issuer or bank charging you as a result of our processing of your credit or debit card payment in accordance with your order. If you order Products from our site for delivery outside the UK, they may incur import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order. Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

DESCRIPTION OF PRODUCTS

The Products depicted on our site are as seen. The reproduction of colours and styles are as accurate as photographic and image processing will allow. We do not accept responsibility for slight variances in colour and style. Plaques as shown in marketing collateral is an artist impression and therefore may look different with exact detail.

CANCELLATION, REFUNDS AND REPLACEMENT OF REPLICA PRODUCTS

Cancellation: You may cancel an order in full (but not in part) at any time within 28 days, beginning from the day on which you receive the Order Confirmation (“Cancellation Deadline”). In order to cancel an order, you must email arsenalplaques@celebrationcorner.uk and specify your order number. Please note that your right to cancel may only be exercised in respect of your entire order. If you submit a valid cancellation request within prior to the Cancellation Deadline, a refund will be processed by The Arsenal Football Club Limited within 21 days of receipt of your request.

Defective Replica Plaques: For defective Replica Plaques returned to us within 30 days of delivery and in accordance with these Conditions of Sale, a refund will be processed by The Arsenal Football Club Limited within 21 days of our receipt of the returned replica plaque. We will refund your reasonable delivery costs of returning defective Replica Plaques upon presentation of valid proof of purchase. Otherwise, you are responsible for all shipping and delivery costs of returning Replica Plaques.  We will usually refund any money received from you using the same method originally used by you to pay for your purchase. If you would like a replacement, this will be to your original Replica Plaque specification as detailed on your original order. Please note that the delivery of returned Products to us is at your own risk. We recommend that you use a courier or signed-for service when returning Products.

LIABILITY

To the fullest extent permissible by law, we exclude and disclaim all warranties, terms, conditions and representations that might otherwise be implied by law in relation to this site and the Products. This does not affect your statutory rights as a consumer.

The Plaques will be installed at Emirates Stadium for 10 years. After 10 years, Arsenal Football Club Limited hereby reserves the right to move, relocate or permanently remove or destroy the products at our discretion.

The Arsenal Football Club Limited’s maximum liability to you arising by reason of or in connection with the supply of the Products to you shall be limited to the amount paid by you in respect of the Products in question.

The Arsenal Football Club Limited’s shall not in any event be liable to you for any loss of profits, business or anticipated savings or loss of opportunity or loss of or corruption of data (whether direct or indirect) or any indirect loss or consequential loss whatsoever (and howsoever arising) even if it has been advised of the possibility of such loss. This does not affect your statutory rights as a consumer.

Nothing in these conditions of sale shall exclude or limit our liability to you for (i) death or personal injury due to our negligence, (ii) fraud or fraudulent misrepresentation or (iii) for any other liability that cannot be excluded or limited under applicable law.

The privacy of your personal information (such as your name, e-mail address, address and other contact details) is important to us. The Arsenal Football Club Limited’s will supply this information to the company employed to fulfil your order, The Arsenal Football Club Limited may supply your details or email you directly with offers and promotions from selected third parties that we think you’ll enjoy, if you do not want to receive these please tick the relevant boxes under where you submit your personal information.

FORCE MAJEURE

The Arsenal Football Club Limited shall have no liability to you for any delay or failure to deliver the Products to the extent that such delay or failure to deliver arises from causes beyond the reasonable control of The Arsenal Football Club Limited including, but not limited to, fire, floods, acts of God, acts or regulations of any governmental or supranational authority, war, riot, strike, lock-out and industrial disputes.

WAIVER

If you breach these Conditions of Sale and we take no action against you, we will still be entitled to use our rights and remedies in any other situation where you breach these Conditions of Sale. No waiver by us shall be effective unless communicated in writing.

OUR RIGHT TO VARY THESE CONDITIONS OF SALE

We have the right to revise and amend these Conditions of Sale from time to time including, without limitation, to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in the design of Celebration Corner plaques, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.

You will be subject to the policies and Conditions of Sale in force at the time that you order Products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Order Confirmation (in which case we have the right to assume that you have accepted the change to the Conditions of Sale, unless you notify us to the contrary within seven days of receipt by you of the Products).

ENTIRE AGREEMENT

These Conditions of Sale, current Product prices, delivery details and contact details on this site, set out the whole of the agreement between you, The Arsenal Football Club Limited. You confirm that you do not rely on, and waive any claims for breach of, any such representations, which are not so confirmed.

GOVERNING LAW AND JURISDICTION

Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such contracts or their formation (including non-contractual disputes or claims) will be subject to the non-exclusive jurisdiction of the courts of England.
